A trade secret is a formula, practice, process, design, instrument, pattern, or compilation of information which is not generally known or reasonably ascertainable, by which a business can obtain an economic advantage over competitors or customers. An individual or company can protect its confidential information through non-compete and non-disclosure agreements with its employees within the constraints of employment law. Trade secrets do not expire and if properly protected the confidential information of the trade secret can provide a perpetual monopoly regarding the secret information. However, third parties may independently duplicate and use the trade secret information once discovered and can even patent inventions related thereto.
