Trade Secret Services
A trade secret is a formula, practice, process, design, instrument, pattern, or compilation of information which is not generally known or reasonably ascertainable, by which a business can obtain an economic advantage over competitors or customers. An individual or company can protect its confidential information through non-compete and non-disclosure agreements with its employees within the constraints of employment law. Trade secrets do not expire and if properly protected the confidential information of the trade secret can provide a perpetual monopoly regarding the secret information. However, third parties may independently duplicate and use the trade secret information once discovered and can even patent inventions related thereto.
The BrooksGroup can provide assistance in establishing and maintaining trade secret programs to assure that the information to be protected is kept secret and not generally known to the public. The BrooksGroup can provide advice regarding basic practices including the use of confidentiality agreements, physical and technological controls on the use of information within the organization and the performance of periodic audits of trade secret information.
